1. Acceptance of Terms

By accessing or using the Trans Web platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Trans Web (Pty) Ltd ("Trans Web", "we", "us", or "our").

2. Description of Services

Trans Web provides an online freight management platform that connects shippers, freight brokers, and transporters. Our services include freight posting and assignment, partnership management, credit-based billing, and related logistics management tools. Trans Web acts as a technology platform and is not a freight carrier, broker, or logistics provider.

3. User Accounts

To use the Service, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Each account represents a business entity ("Tenant"). Account administrators may invite additional users to their tenant account. All users within a tenant are bound by these Terms.

4. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for any fraudulent or illegal activity
  • Misrepresent your identity, company information, or freight details
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorised access to any part of the Service
  • Use the Service to transmit harmful or malicious content
  • Violate any applicable laws or regulations

5. Payment and Billing

Trans Web operates on a credit-based billing system. Users purchase credits which are consumed when publishing freights. Subscription plans may include a monthly fee in addition to per-freight credit costs. All payments are processed through PayFast, a third-party payment provider.

Registration fees and subscription payments are non-refundable unless otherwise required by applicable law. Unused credits remain in your account and do not expire. Trans Web reserves the right to modify pricing with reasonable notice to users.

6. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Trans Web and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any data and content you submit to the Service. By submitting content, you grant Trans Web a non-exclusive licence to use, store, and process such content for the purpose of providing the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Trans Web shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Trans Web does not guarantee the accuracy, reliability, or completeness of any information provided by other users on the platform. Users are responsible for verifying the credentials and reliability of parties they engage with through the Service.

8. Termination

You may terminate your account at any time by contacting our support team. Trans Web reserves the right to suspend or terminate your account if you violate these Terms or engage in activities that may harm the Service or other users.

Upon termination, your right to use the Service ceases immediately. Any remaining credits in your account at the time of termination are non-refundable unless otherwise required by applicable law.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Changes to Terms

Trans Web reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
